Agreeing to these terms
By using Confirmity, you agree to these terms. If you use it for a center or company, you confirm you can agree for it, and "you" means that organization.
What Confirmity is
Confirmity is software for rehab and behavioral health centers. It reads payer rules, checks work before it goes out, and prepares drafts for your team to review.
Confirmity provides operating intelligence for behavioral health organizations. It does not guarantee clinical outcomes or clinical necessity determinations, and it does not guarantee payer approval, claim payment or reimbursement.
Your team makes the decisions
Confirmity's agents draft and flag; they do not send, sign or submit on your behalf. You are responsible for clinical, billing and compliance decisions, and for reviewing what you approve.

Accounts and seats
Each person uses their own seat. Keep sign-in details private, do not share accounts, and tell us right away if you think an account has been misused. You decide who gets which seat.
Your data
You own the data you put into Confirmity. We use it only to run the service for you. If you put PHI into Confirmity, a business associate agreement must be signed first; until then, use sample data only. The BAA and our privacy policy explain how we handle it.
Acceptable use
Do not use Confirmity to break the law, to access data you are not allowed to see, to interfere with the service, to probe its security without our permission, or to resell it without an agreement with us.
Fees
Paid plans are billed as your order or customer agreement says. Fees are due as stated there.
Changes and availability
We improve Confirmity often and may change features. We work to keep it available but cannot promise it will never be interrupted.
Ending use
You can stop using Confirmity at any time, under the notice terms of your agreement. We may suspend access for serious misuse. When an account ends, data is returned or destroyed as your agreement and BAA say.
Warranties and liability
Except as your signed agreement says, Confirmity is provided "as is," without warranties of any kind, to the extent the law allows. To the extent the law allows, our total liability is limited to the fees you paid us in the 12 months before the claim, and neither side is liable for indirect or consequential losses.
Governing law
These terms are governed by the laws of the
State of Ohio, without regard to its conflict-of-law rules.
Changes to these terms
If we change these terms we will update the date at the top. Continuing to use Confirmity after a change means you accept it.
